Our competition practice holds all required resources for proficiently addressing legal, regulatory, and economic aspects of business competition on behalf of clients in a broad variety of industries.

We are experienced in advising and defending clients in competition cases across a full range of issues, including horizontal and vertical agreements, abuse of dominant position, merger control, state aid or unfair competition.

Our attorneys possess the courtroom strength needed to protect client interests in competition related disputes. We hold the capability to sustain any court challenge against measures by the Romanian Competition Council.

A significant part of our competition practice is dedicated to guiding clients on risk mitigation and avoidance of liability. We address various prevention measures on matters as information exchange among competitors or whistle-blower and leniency treatment.

CMP’s corporate & contracts practice group advises on a broad range of matters including start-up assistance, mergers and acquisitions, equity and debt financings, all species of domestic and cross-border commercial transactions, establishing joint ventures, and general corporate assistance.

Our attorneys support management bodies on a wide variety of corporate governance topics, including directorial duties, corporate compliance, risk assessment and management, representation on board committees, corrupt practices inquiries etc.

Taking a case to court can be very costly and distracting. Therefore, we endeavor, whenever possible, in finding constructive and cost-effective solutions by alternative means such as pre-trial negotiations and mediation proceedings. However, where litigation cannot be avoided, our litigation practice group has the depth of experience to ensure that, throughout the process, the client will receive clear, honest and result-oriented advice, and our full support.

CMP’s litigation practice group handles a full suite of civil and commercial litigations, including administrative disputes, taxation related disputes, public procurement related disputes, IP infringement disputes, employment law, in-tort proceedings, product liability and consumer protection proceedings, insurance coverage, litigations relative to corporate operations and complex commercial transactions, competition disputes.

A significant part of our business involves assisting our clients apply their collective agreements and settle any ensuing grievances. Our expertise covers a broad range of situations, including dismissals, disciplinary action and interpretation, workplace policies, employment manuals, sickness and disability, pensions, labor protection.

Our team supports non-unionized clients, as well as businesses that are subject to union matters. We also work with our clients in connection with corporate transactions to ensure employment issues are identified and addressed.

Our Real Estate practice ranges from specific property and related transactions to property issues that arise in commercial transactions.

Our public procurement practice group renders full legal support to:

  • suppliers, service providers and contractors on the applicability of the procurement law
  • tenderers on participating in award procedures for public works, supplies and services contracts
  • contracting authorities on preparing public tenders and detailed procurement structures
  • contracting authorities and tenderers in litigious proceedings relating to public tenders and in other contentious proceedings concerning alleged breaches of public procurement law

Our team advises and represents clients in a large array of contentious tax issues, ranging from drafting appeals against adverse decisions of the Romanian tax authorities to support and representation throughout the entire litigation process. When analyzing a tax law related issue, we always have in mind our client`s business operation and propose

practical solutions. CMP offers advice in various areas such as excise duties, authorization procedures before customs authorities, statutory social contributions, taxes and duties owed by companies, employers and employees etc.
